This is a standard response message which comes after USCIS receives the response to RFE and resumes case processing.
There is no way to determine when the case would be adjudicated and what will be the result. It could happen next week or take months.

If one has Green Card based on family preference (son of US citizen), how long he has to stay in USA to maintain his Green Card. I heard it is min 180 days in a year ? Is that correct ?
What are other restrictions ? Does it impact citizeship ?
A detailed answer would be very helpful.
Also If one has Green Card which one if faster router to get his spouse to USA:
1. Applying as daughter in law of US Citizens. Or
(what family preference catergory this is ?)
2. Applying as wife of person having Green Card
(what family preference catergory this is ?)

My PD is 08 july 2004. ND 08/09/2009 (NSC) and no approval yet. Multiple SLUD's from 4/2/09 - 04/16/09 on dependents and my cases after we sent response to RFE.
Last update was on 04/16/09.
Opened an SR on 09/03/09 and the wait goes on ...
Its furstrating to see the "Inorderly" and "out of turn" approvals ...
I don't want the miss the boat as PD later than me are using up the numbers.
There must be lots of IV members who are in similar situation.
Attorneys please suggest how we should tackle this.

Friends,
I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.
I will complete my 3 years. But after this project is over, I don't know I can find the job again.
My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?
What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.
I am really confused. Please give me your suggestions

Hi,
I am currently on H3 visa. My 2-yr term is coming to an end. My company had initially told me that they would find me a job internally and then relocate me to another location outside of the US after my training ends.
However, the company has not been able to find me anything in other regions, which essentially means I will be laid off. I want to know if the company is liable to pay me severance / air tickets back to my home country??
My employer is currently saying that they are not responsible for my airfare. That provision is only for H1B's. However, if the intent of H3 visa was to bring me for training and transfer me so that I could use that knowledge somewhere else. Even in the H-3 filing papers my company stated that their intent was to provide me employment in other regions after the end of the training. I don't understand how can they leave me stranded. They should be liable for something (severance, airfare)??
Please reply if you have any advice.

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

Hello,
I have a h1b visa that will expire in March 2010. This visa has been already renewed for its second time so, as you know, I wont be able to renew it once again.
Currently I am applying for permanent residency ( EB3 category) and I am in the AOS phase. I have the possibility of renewing EAD's every year, but I need to understand what is going to happen when the H1b expires. Can I renew EAD's even after the visa is no longer valid? How does it work?

I hyphenated my name while I was applying for a green card. All of my Canadian documents like my passport and my Canadian photo ids like my Ontario drivers license and health card are all in my maiden name. Can I bring my green card alone with no other documents or do I need some other government issued id? The only thing that has my current name is my green card. What do I need to get a license.

This is purely my opinion and may not be the best legal advice. If I were in the same situation, I would go by the EB type (EB2 first) and then by the priority dates. Whichever one is higher, I would apply both in that classification. If both I-140's are EB3 and same priority dates, I would go with the one with better job security (stable employer and job) and keep the other I-140 as backup. In this day and age of corporate acquisitions, mergers and bankruptcies and USCIS backlogs, you want to use the option with the least risk.

My wife and I, currently have EADs. My wife has been offered a job and they need a Green Card when she joins in May 2008.

PERM takes from 2 weeks and upward. Mine took 9 months. Why? nobody knows. My friend's first PERM (eb3) took 6 months. Second (eb2) took 2 weeks.
You can file for I-140 (+ I-485) only after LC approval and if your date is current (for your country and your category).
