    I am applying to renew my EAD and looking at the paper Application on page 7 I see that if you are C9 which all of us are mostly..we need not file an application fee..
    Is it true..
    Plz help

    If you paid the new fees when you filed last year then you don't have to pay the fees again this time. But if you paid $180 for ead then pay again now.

    I have 2 questions

    1) When do I have to apply for the 140 after the labor approved; what is the max time allowed after labor approval.

    2) Name Correction in labor; what is procedure to correct my approved labor certficate and when/how to do this ...

    Yes he is in 'Adjustee Status' also a person can start working as soon as new employer files H1 petition on his/her behalf. So if the petition was filed on time and took 40 days to be approved your friend was in H1 status since the day the petition was received by USCIS

    I was just wondering why legal immigration is not generating any interest with the beloved politicians in this country. Inside the mind of these politicians... I guess their agenda is very clear.

    Immigration support for illegals = hispanic votes = reelection!
    Immigration support for widows = sympathy votes = reelection!
    Immigration support for same sex partners = more votes = reelection!
    Immigration support for serving the military = Show of patriotism = society respect!

    But,

    Following are my case details -

    Visa and I94 expiration date: 12 Sep 2009
    Filed extension: 11 Sep 2009
    Extension denied: 18 Nov 2009
    Left US: 15 Dec 2009

    Refiled H1 Visa: 15 Dec 2009
    Visa apporoved: 22 Dec 2009

    What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?

    Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

    Kindly suggest.

    As long as your company is generating Paystubs you are not outofstatus. but if there is an audit and if INS finds that you have not paid then its will be an problem.

    Though I have started only one theread in last three years of my membership, I can't resist a temptation to start one now. From the following article in WSJ the lame duck session now appears certain and it is going to be in this month !!!!!!!!!!!!

    Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.

    Any suggestion.

    USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."

    Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.

    Hello Everyone great community here and very useful information.

    Received the email from Cris I-140 approved today.

    I just would like to know how long it should generally take for I-485 approval. Now visa's were current when I file I485. What is the status now do I have to wait for visa's to be current again? Sorry for lack of knowledge GC process takes so long sometimes its good to just forget about it :)

    Here is the data:

    H1 8th year still current :)
    EAD 07/07
    AP 07/07
    PD AUG 2003 EB3 Retro
    I-140 Approved Today
    FP 10/07
    I-485 pending since 07/07 ???????????????????
    AC21 Invoked 04/08
    TCS

    Anyone in the same boat? Appriciate any responces.

    take a infopass and visit your local USCIS office. they might have an answer.
