I am on an H1B visa. I have passed PERM and my priority date is Sep 2005. Then I applied to 140 and in the middle of 140 (it was last year in Aug), I changed my company. My new employer hired me for the same position and renewed my H1B for the same position. After a few months 140 was approved but it is from my old company.

Now, can I still apply to 485 even though I don't work for my previous company? In what circumstances, could this be worked out? what do I need to do?

    HAS ANYBODY EXPERIENCED THIS BEFORE?

    Thanks,

    kartal

The H-1B visa is, by far, the most sought-after temporary work visa in the United States for foreign-born, professional workers. The H-1B category requires sponsorship by a U.S. employer and is limited to specialty positions which generally require the candidates hold at least a bachelors degree or the equivalent in a relevant discipline. It now appears that the impact of the economy on H-1B usage will be felt for at least another year. The annual cap or quota for new H-1B visas is set by Congress at 65,000 new visas per year, not including the 20,000 H-1B visas available under...

If you can get to the soft copy of the checks usually provided by most of the banks, you can find the receipt number on the rear/back side of the check.

    Dear Attorney,

i would like to join a very good opportunity on EAD but have one concern shown below.

"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"

Your advice will help me alot and would be really appreciated!!!!

    Thanks,

While the media is obsessing over Harry Reid's embarrassing comments about President Obama, Politico reports on another juicy story reported in Game Change, the new book on the 2008 campaign: [McCain aides John] Weaver and [Mark] Salter begged McCain to ease up. He was already the face of the Iraq surge. Now he was becoming the face of what opponents called 'amnesty.' Just tone down the rhetoric, his advisers pleaded. McCain refused. He was disgusted by republicans in Congress and talk radio gasbags such as rush Limbaugh who bashed immigrants. 'Theyre going to destroy the f**king party,' he would say....

The fact that the GOP has no clear plan to win the election next year other than hoping President Obama fails so miserably that people will feel no choice but to vote Republican became more apparent yesterday. The Senate Judiciary Committee voted 13 to 6 to confirm Judge Sotomayor as the next Supreme Court Justice. And only one Republican voted in favor of the nomination. The GOP got shellacked by Hispanic voters last year - losing 3 out of 4 votes compared to getting nearly half of those votes in 2004. And political analysts are in general agreement that the...

Say if one has two I-140 and wish to port the priority from the older one to the later one. And if the USCIS does not agree with your filing(maybe they will say the filing is not possible or not portable). What will they do? Will they deny the I-485 or will they just reject the application. If so will it cause an issue when the later priority date is reached and during the application of the following I-485.

    Hi Experts,

My wife is on H4 visa and has started her MS in CS in Jan. She applied for her change of status to F1 visa on 15 th feb. As of today (17th March), her approval notice hasnt come and her H4 is expiring on 31st March. I am not even able to follow her case online on USCIS coz her return recipt number is not updated at all. This is quite common I have heard.

My question is, should we also apply for her H4 extension before 31st of this month so that in case her approval for F1 does not come before her H4 expires and in worst case it gets rejects, she still wont be out of status coz her H4 renewal application is in place or am i just being too paranoid and should just wait for her F1 to come??

    Thanks.

"I'm having to deal with the reality of what is. You can't wish it away. What is, is." So says a glum Ohio Democrat, Governor Ted Strickland, according to reporter Laura Meckler in this weekend's edition of The Wall St. Journal ("Democrats Face Economic Facts: Updraft Unlikely"). Meckler's article reports on the prospect that Democrats "will lose their majority in the House," citing two nonpartisan election handicappers, the Rothenberg Political Report and the Cook Political Report. What would shared power portend for immigration reform if the GOP took control of one or both houses of Congress? Before that question can...

    Hi,

I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?

This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

    Thanks.

St. Jude Children's Hospital is known throughout the world for its groundbreaking research relating to childhood cancer. One of their stars is Australian-born Charles Mullighan who has gained attention for discovering what is described as "the missing piece" in the puzzle of genetic mutations that contribute to the onset of childhood leukemia. Mullighan recently described his work to the Memphis Business Journal: The most common childhood cancer, says Mullighan, is ALL, a genetic disease. He explains that ALL stops normal white blood cells, which constitute the bodys natural immune system, from growing; without adequate natural immunity, infections eventually overwhelm and...

Also, for 140 application do I have to sign on any PERM labor related document ?
