    My wife is currently on a B1/B2 status which is valid for 10 years. She has an appointment to get her H4 stamped next week. Can she have both the B1/B2 and H4 visa stamps at the same time or will they "Cancel without prejudice" the B1/B2 after the H4 is stamped?

    Is there a way to request the consulate not to cancel the B1/B2 visa?

    Hi,

    My husband is on H1-B, and it expires on Feb 4th 2007. We plan to go to India, leaving the U.S. on Feb 11th 2007. His current I-94 expires on Feb 4th 2007.

    We have our I-140 and 485 filed in parallel. He has received his EAD and Advanced Parole.

    His lawyer wants to apply for H1-B but not use premium processing, as he can re-enter the U.S. using Advanced Parole.

    Now, our concerns are these:

    1. If he leaves the U.S. AFTER the expiration of his current I-94 WITHOUT having a new I-797, can it look as if he overstayed?

    2. If he re-enters the U.S. using the Advanced Parole, will that change his status so that he is now considered to be on immigrant(EAD) rather than non-immigrant (H1-B) status?

    Basically, we want to insist on premium processing and go for the H1-B visa stamp while in India to be sure that he does not go out of status.

    Any advice on this?

    I have my I 140 and I 485 (Aug 07 filer) for a future employment from a small company with EB2 as software engineer. I 140 still pending and got an RFE. I got the EAD. In a month am going to finish 180 days.


    Currently, I work for Fortune's Best software company as sr. software QA engineer. My company wants to go ahead filing for my GC.

    As this current company being a best american software company and I can stay for any longer, I wish to go ahead with filing for a fresh GC. However, I was wondering how I could use the benefits of the priority date from the previous 485 filing mentioned above. my company attorney suggests that am eligible for EB3 where as my 485 already filed is under EB2.

    What would be the implication if my current employers files for EB3 and my previous I 485 filing is under EB2. What are the options that are available for leveraging the benefits of my previous filing or using EAD?

    What is the best course of action.

    White House Press Secretary Robert Gibbs said there are not enough votes for the Obama administration to achieve its desired immigration reform, and change in the system as we know it today.

    The plan was derailed when conservative activists, who claimed the program would have constituted "amnesty" for illegal immigrants, managed to pick off enough Republicans in the House and Senate to forestall a vote. Gibbs said that the White House would make an effort, though, to win the votes for a reform plan, for which President Obama reiterated his support.

    My attorney is asking $500 for filing both EAD and AP as filing fee. So was wondering how difficult it is to file by my self. Does anyone has expereince filing for renewal.?

    I recommend visiting USCIS page at USCIS - FORMS (http://www.uscis.gov/forms) and doing it yourself as it is the best way to master this.
    It is a simple form except that you have to patiently go through the instructions.

    As for identification document, if you are applying for an extension of EAD, copy of front and back of previous EAD is enough. You don't need to provide a drivers license copy or any other form of identification.

    I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service.     That requirement is only for foreign passport holders travelling on visa/or visa waiver.

    Us citizens are required tp present a non-expired passport, it does not say how long the passport needs to be valid for

    My friend currently is in his home country. He worked with H1-b before, and left US because of being laid off (could not found a new job in time). His question is if he can apply for B2 and go to the US first, then stay in US looking for a job. After getting an offer, transfer his previous H1-b to a new company. Can he do like that? Thanks!

    Now that the EB2 dates have moved forward till Dec 2003, how many of us expect our approvals in the coming months ? Would the bulletin move forward in coming months or would go back or may be become unavailable again ? Any thoughts ?

    I hope the same forward movement happens for all EB3 applicants too.

    How does one now expedite thier case if they are current ? Just by 1-800 .... calling or Infopass ?
