Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

Your friend's wife should be okay. As long as the marriage took place before his I-485 approval he can add his spouse for an AOS or follow to join application even after the approval(within limited time window, of course).
In this case the application was sent before the approval so there should be no problem.

Get a job ASAP - when ur 485 is being adjudicated - they will ask for job proof and it would be good to have as many paystubs.

I was looking into user profile options.
there are two choices for - I140 Filing Type
- Regular
- Premium
What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 4 weeks ago and it was received by them the next day(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

First of all I am filing by postal mail USPS(not e-filing)
1)is it necessary to include I-765 receipt notice(EAD) with my AP application.. But I have only my last years one which will expire in a few months.
2) for AP renewal is it necessary to include marriage certificate for spouse
3) When filing by postal mail, and also considering i applied my I-485/I-140 before july 30/2007, old fee schedule... do i need to pay biometric fee for my renewal
4) I am in Texas and for mailing EAD and AP - can I send them together for me and my spouse. I see different PO Boxes for EAD and AP addresses for the Mesquite, TX address
IN I-765, is it enough only to specify the previous EAD information regarding the office filed and receipt date...or do i have to include my OPT EAD as well as my previous EAD filed last year.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. (1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.
(2) On the other side, I may not have worry as my Labor was filed in year 2003.
Any Clarifications?

Someone told me that I-140 have to be applied 45 days from PERM approval ? Otherwise PERM will get cancelled. Is that true. Can anyone help here.

If you engage in employment, including self-emplyment outside of your H1 employment you violate the terms of your H1 status. If USCIS becomes aware of such employment, they will find that you gave up H1 status.
