I've looked in the forums but haven't been able to find an answer for my question. Here's my situation:
EB3 I-140 pending under "Software Engineer" position. 485 has already been applied.
I would like to start a EB2 PERM for a "Senior Software Engineer" position.
Would this constitute a conflict of interest and jeopardize my EB3 140 resulting in a denial?
PS: The intent is to interfile when applying for EB2 140.

My company has been going through layoffs for the past 3 quarters and are unable to start my GC process. I believe they have to wait for 6 months before they go forward and apply. I am talking about a big company with different departments like operations, marketing and most of the layoffs are happening in these, but recruitment is active in IT. They are regularly recruiting new resources and increasing the head count.
I have following questions:
1) Can my company show that the layoffs are happening in different depts and go ahead and process my GC?
2) What is the risk in doing so.
3) Anyone experiencing a similar situation and could successfully get their GC process started and have approved labor/I140?

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. And since then I've noticed that when I do presentations for civic groups or have observed focus groups on immigration, the older attendees seem to be more hostile. My Receipt date for 485 is july 27th 2007 and nebraska is processing applications for this date.
I applied for cross chargeability on 10th March.. Any idea how long before my case is approved? My lawyer has confirmed that its possible and he claims that it should take 4-8 weeks. I wanted to check to see what the experience of people has been so far?

Hello! I went to US to work in a summer/work travel experience under a J1 VISA.
My VISA expired on APR/01/2007 , but I sent a letter to USCIS asking to change my VISA status to B1/B2. The letter just arrived at the USCIS Office on APR/02/2007. I kept working until JUN/15.
In JUN/20/2007 I left US back to my home country and later accessing the USCIS site I figured out that my request was processed and denied.
Now I'm graduated in Business and was hired to work in a big company in NYC, they are requesting me to get another J1 VISA (this time J1 Trainee for a 1,5 year).
I would like to know if this kind of situation generates a BAN, or if I will have any kind of trouble in the interview in the US Embassy.

I know this may be a little of topic but just bear with me. I am simply looking at alternatives in case the GC does not pull through. Does any one over here have any experiences living and working in the Middle east ? I just read an article about Saudi Arabia's economy dealing with record unemployment. They are in the process of taking jobs away from foreigners and giving it to the locals.
Where do we go to look for jobs in the Middle east. Any advice on this topic would be greatly appreciated. I'm praying my GC does finally pull through.

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.
