    I am working for a MNC and I got L1 visa stamped. After marriage I got my H4 visa stamped.(After L1 stamping) But the Visa officials have not marked the L1 visa cancelled in the passport, does it mean that the Visa is still valid? Does that mean that i can still travel on my L1 visa?

    If your L1 petition is still valid (not withdrawn by employer) and you intend to work for that employer (ie. fullfill all other L1 requirements) then yes, you can still travel on L1 and maintain L1 status in the US.

    hi attorneys,

    my H-1B petition is valid for another 3 months. we applied for my H1 extn and my spouse H4 extn 2 months ago. both r still pending.

    my spouse H4 petition expired last month. since we applied extn b4 it expired, my spouse can stay in usa legally.

    now my spouse wants to travel abroad for a family function.

    questions:
    (1) is it fine to travel abroad with H4 extn pending? (pls note that the H-1B holder will not be traveling)

    (2) if H4 extn is approved with new I-94 when abroad and my spouse gets another new I-94 at POE when returning, then which I-94 will be the latest valid one?

    Hello

    We moved to a new location after filing our 485, EAD and AP petitions. We immediately sent the AR11 forms (by Fedex) and also did the AR 11 form online. Apart from this we updated the addresses for all pending petitions.

    The status is as follows:

    1. My wife's EAD went to the old address and fortunately USPS forwarded to our new address. However my EAD has not yet reached me though when I check online it looks like it was approved on 1st Oct. How do we track this?

    2. I have received the address change confirmations from USCIS for my 485 petition. I have not received the same for my wife and daughter's petitions. Do I have to go and update the address change once again online?

    Kindly advice based on your experience.

    You should bring evidence of your strong ties to the country where you live now - evidence of a job, family, house, club memberships, bank accounts, etc. Anything you can think of that would show an immigration officer that you really intend to return home at the end of this trip.

    I was wondering how many people really got the opportunity to use the reinstated PPS service for I-140 petition? Has it been useful to the most of people who are stuck in the I-140 backlogs for more than year now or has it only helped a tiny segment of the folks who really needed it to maintain their status?
    What is the purpose of USCIS reinstating this PPS if it only helps only very few people. I think its time, USCIS either process the pending applications soon or reinstate PPS for everyone. 1 year is a long time to wait for an I-140 approval when USCIS can re-allocate the staff at quick notice (like those folks who received EADs in two weeks during June 08) if they want to. Its high time USCIS address this issue and get us out of this mess. Visa numbers does not have to be available to process I-140..so there is no reason for them to delay or give excuses.

    This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

    I am a I-485 EB waiter and applied before August 18th. So I have to pay a fee fo 305 dollars. However when I went to check the I-131 instructions for e-filing, i could not find any information if we are eligible to e-file?

    has anybody e-filed Advance parole.

    Hi,

    My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.

    We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.

    I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).

    Any advise would be appreciated.

    A story told in cloakrooms of the House of Representatives shows how ironic life on Capitol Hill can be. Jim McCrery, the low-key, hardworking ranking Republican on the Ways and Means Committee, has spent all year trying to establish good relations with the tax-writing committee's first Democratic chairman in 12 years, Charles Rangel. He succeeded, only to discover that Rangel does not really run Ways and Means. Nancy Pelosi does.

    Rangel, a crafty New York politician, so far looks like the weakest Ways and Means chairman during my 50 years in Washington. That's only because Pelosi so far is the most powerful speaker of the House during that same period, a reality obscured by her historic role as the first woman to hold that office. She does not confer with or defer to standing committee chairmen, whose predecessors made previous speakers dance to their tune.

    On both sides of the aisle, the 67-year-old grandmother from San Francisco is referred to as the "Committee of One" who rules the House. Many speakers over the years relied on their majority leader, as Republican Dennis Hastert let Tom DeLay handle day-to-day operations. But not Pelosi, who actually opposed Steny Hoyer's election as majority leader.

    Ruling absolutely does not mean all Democrats think she rules well. Her misguided effort to pass a resolution condemning the 1915 Armenian genocide constitutes a rare public blunder, but beyond that she has not crafted a coherent Democratic message. This month's Harris Poll puts her nationwide job disapproval ("fair" or "poor") at 57 percent. But she is an icon at the Democratic grass roots, and none of the committee chairmen who have been downgraded by her -- certainly not Rangel -- utters a word of public criticism.

    Rangel's massive tax reform proposal, released last week, gets less respect than is normally accorded to a Ways and Means chairman's plan, because Pelosi is not on board. Rangel's desire to compromise with the Bush administration on international trade agreements has been frustrated because the speaker defers to Rangel's trade subcommittee chairman, Sander Levin, who follows organized labor's protectionist line.

    Much the same treatment has been experienced by John Dingell, the senior member of Congress, as Energy and Commerce Committee chairman. In bygone days, Dingell deferred to neither Democratic presidents nor speakers. But Pelosi is determined to pass an energy bill this year even though it means crossing Dingell, who as a Detroiter opposes Californian Pelosi on vehicle mileage and emission standards. A sage old professional, Dingell knows there is no political profit in publicly clashing with Madam Speaker.

    No committee chairman wants to take the risk of going public against Pelosi, including one who sought her advice -- and, hopefully, support -- on a controversial matter of House business. This anonymous chairman was rebuffed by the speaker, who declined to talk to him, in person or over the telephone.

    Being the "Committee of One" does not mean Pelosi is without lieutenants. She is close to two fellow Californians, both fiercely partisan, who head committees: George Miller (Education and Labor) and Henry Waxman (Oversight and Government Reform). Miller is regarded as her consigliere, always at her side. She is also considered close to moderate chairmen Ike Skelton (Armed Services) and John Spratt (Budget), plus liberal chairman Barney Frank (Financial Services).

    That does not mean, however, that she always takes their advice. Witness her big blunder as speaker. Skelton, a seasoned student of international relations, told her the Armenian resolution would antagonize Turkey and thus constituted a foreign policy debacle in the making. Rahm Emanuel, the House Democratic Caucus chairman, also opposed it (as he had when serving as President Bill Clinton's political aide). Pelosi insisted until some 45 House Democrats -- including Skelton -- opposed her.

    The Armenian episode suggests a Pelosi decision has to approach the brink of disaster before Democrats speak out. Her popularity in the party beyond Capitol Hill is too great. When I asked one esteemed Democratic operative whether Pelosi's authority is without restraint, he called that a sexist question because I never would have asked that about Sam Rayburn or Tip O'Neill. Indeed, I would not have. They were not that powerful.

    Jul 2nd filer. EAD approved late Sep and notice mailed on 10/2/07. (LUD on EAD 10/2)
    There is a LUD on the AP application on 10/4/07, but the status still says case received and pending. What could this LUD be ?

    When I saw the LUD (with 10/4) I got excited and thought AP was approved too, but when I click the case details , it still says pending. The text of the details did not change.

    As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    WASHINGTON, May 18 � Hours before a bipartisan deal on immigration policy was to be announced Thursday, a tenuous compromise was threatening to unravel, and tempers flared once again.

    Just off the Senate floor, Senators John McCain of Arizona and John Cornyn of Texas, both Republicans, exchanged sharp words, with Mr. McCain accusing his colleague of raising arcane legal issues to scuttle the deal. Mr. Cornyn retorted that he was entitled to his view and noted that Mr. McCain had spent more time campaigning for president than negotiating in recent weeks.

    The senatorial dust-up, described by witnesses, was just one of the tense moments in remarkable negotiations over the last three months that resulted in this week�s accord. Senator Arlen Specter, the Pennsylvania Republican who oversaw the talks, compared them to a floating craps game, with a changing cast of characters and shifting sites.

    Lawmakers and staff members who participated said passions occasionally ran high in the dozens of meetings, with Senator Edward M. Kennedy, Democrat of Massachusetts, sometimes using his temper as a negotiating tactic. Senators who had spent hours anguishing over the smallest details had little patience for colleagues who made brief appearances to offer their views.

    �New people came in and wanted to revisit the whole deal,� Mr. Specter said. �That happened all the time. It was very frustrating.�

    In the end, negotiators overcame political divisions and some level of distrust to produce the agreement that will be debated in the Senate beginning next week. Lawmakers said they forged bonds partly through the telling of personal stories about their own family roots, as well as long hours spent together and the prospect that the bill might be a last chance at reaching consensus on a major national problem.

    �It was like waiting for a baby to be born,� said Senator Lindsey Graham, Republican of South Carolina, about the negotiations. �On occasion, it was like being in mediation with a divorced couple. It was like being at camp with your buddies. It was feeling like a part of history.�

    As difficult as the negotiations were, they might ultimately seem tame compared with the fight the authors of the plan now face. Before the language of the bill was even published, the proposal � a major domestic objective of the Bush administration � was under attack from the right for allowing illegal immigrants to earn citizenship and from the left for dividing families. The offices of the negotiators were under siege from critics who had the phones ringing endlessly.

    �It is real easy to demagogue this thing, and some people probably won�t be able to help themselves,� said Senator Mel Martinez, Republican of Florida and another key participant in the talks. �We are going to have to stick together on the fundamentals of this agreement.�

    The talks had their genesis in last year�s failure on immigration after House Republicans essentially chose to ignore a bill passed by the Senate that conservatives derided as amnesty since it would have allowed some of the 12 million illegal immigrants in the United States to remain and eventually qualify to be citizens.

    President Bush helped plant the seeds of this year�s negotiations on Jan. 8, at a White House event celebrating the fifth anniversary of the No Child Left Behind Act. Mr. Bush pulled aside Senator Kennedy, and they went into a room off the Oval Office to talk about immigration.

    A month later, Senator Jon Kyl, a conservative Republican from Arizona who would become an important figure in striking the deal, began meeting with other Republicans and administration officials to explore ways to find a legislative response to an issue with potent political and humanitarian ramifications.

    When those talks progressed far enough, the Republicans on March 28 invited in Democrats like Mr. Kennedy, a longtime advocate of immigration changes, and Senators Ken Salazar of Colorado and Robert Menendez of New Jersey. What followed was a series of meetings around the Capitol, typically on Tuesday, Wednesday and Thursday nights, as the lawmakers, staff members, White House officials and two or three cabinet secretaries immersed themselves in immigration rules as part of unusually direct high-level negotiations.

    �To take an issue and basically start from scratch and write it from the bottom up is something I haven�t seen done in a really long time,� said Candida Wolff, chief of Congressional relations for the White House.

    The first big hurdle was cleared a few weeks ago when the negotiators settled on what they called the grand bargain, the main outlines of the issues they were going to address. Major elements included border security improvements and other measures that would have to be undertaken before new citizenship programs were put in place; potential legal status for millions of illegal immigrants; new visas for hundreds of thousands of temporary workers; and clearing a backlog of family applicants for residency.

    Republicans also won support for a new �merit-based system of immigration,� which would give more weight to job skills and education and less to family ties. The negotiators decided to adopt a point system to evaluate the qualifications of foreign citizens seeking permission to immigrate to the United States.

    No question was too small for the senators. They asked: How many points should be awarded to a refrigerator mechanic with a certificate from a community college?

    The negotiations were a roller coaster ride that continued until the deal was announced Thursday, with negotiators expressing despair one day and optimism the next.

    �Wednesday evening was one of the most important moments,� Mr. Kennedy said in an interview. �The mood and the atmosphere were good. You got a feeling that maybe this would all be possible. But on Thursday morning, it suddenly deteriorated again.� He told his colleagues that �it�s imperative that we announce an agreement� on Thursday afternoon, or else they could lose momentum. The announcement was made.

    In some respects, the lawmakers benefited from the Congressional focus on the Iraq war as they were able to negotiate below the radar, avoiding the disclosure of every twist and turn in the talks and pressure from influential interest groups. Those involved also said the deep participation of Homeland Security Secretary Michael Chertoff was vital.

    The senators who put together the bill say they have their own reservations about aspects of it. And some of the regular participants, including Senators Cornyn and Menendez, have backed away from endorsing it. But those who have embraced the bill say they intend to see it through.

    �We made a pact,� said Mr. Specter, who was referred to as Mr. Chairman even though Democrats control Congress. �We will stick together even on provisions we don�t like. We are a long way from home in getting this through the Senate.�
