    Hello,

    I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

    HELLO FRIENDS,

    I am not sure if this has been ever discussed or no but will appreciate any pointers on it : Can one keep extending the H4 visa even if EAD is been used?

    I filed paper based AP at Nebraska service center and got AP in 5 weeks. Pretty painless except paying them 300 for 2 pieces of paper is outrageous.

    Hi,

    I have applied for H1-B in India from Comany B in 2007 and got H1-B approved peititon.
    Later on I got L1-A visa from my company A in Feb 2008 and came to USA on L1-A visa in Feb2008 and working for comany A till date on L1 visa.

    Now I want to change my status from L1A to H1-B to join company C .

    My H1 petition is valid till 2010 October. My questions are

    1. Can I change my status from L1A to H1B any time before October 2010(H1b expiry date).

    if not, How many months before I need to change from L1 to H1b before my H1b petition expires.

    2. My current project is still ongoing till October,2010 and I am with L1 status. so Can I wait till October and then apply for change of status to join new company C on H1-B visa.

    Need your help.

    I am married to a US Citizen and we filed my I-130 petition, which was approved in April 2007. However, the I-797 also notice said that I was not eligible to adjust status from within the US based on evidence presented in the I-130 and that we should consult a local USCIS office to determine what this evidence was. When we consulted an officer at the local USCIS field office, we were advised to proceed with the filing as the language about ineligibility to adjust status in the US was 'standard'.

    We have since filed my I485, application for EAD, and AP. Unfortunately I didn't know about priority dates and their impact on our filing. if my priority is not current does this mean that the 485 will be rejected?

    My daughter is on F1 visa since she turned 22 years. She has her AOS (employment based dependent on me) pending. I-140 cleared and I -485 filed before she turned 22 years. She has also received her EAD and AP based on pending AOS.

    We are planning to go to Canada and she want to use AP for reentering USA. My question is:

    1) Once she enter USA using AP what happens to her F-1 status? Can she continue her F-1 status?

    Appreciate guidance from Gurus/ Lawyers.

    My labor/I-140 documents show my salary to be 85K, I am yet to receive my I-140 approval from Nebraska Processing Center, filed in June 2006 under EB-2. Would it cause any problems when I file my I-485 ( priority date March 2004 ) next year if the salary for 2006 is less than 85K ? I was unemployed for two months this year unexpectedly. Thank you for your responses.

    No one from EB3 category posting their success story of geting a GC recently. What does that mean, VB PD is just foolling us and making you to go crazy.

    Now the Wall Street Journal picks up the theme. Words are nice. But if you can't control the vitriol coming from the Tea Party wing and actually work with Dems on immigration reform, you're not going to reverse the damage. In short, conservative Hispanics still perceive the GOP as anti-them. And PR campaigns aren't going to fix that problem. But promoting pro-immigration candidates, as some groups mentioned in the article are doing, is a hopeful sign.

    I'm going to India and is planning to get my h1 visa stamped...

    How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...

    I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..

    Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...

    Can someone pls advise me on this?
