Hello everyone,
This week because of recess all the senators will be in your home town. From March 27 things will move very fast. This is the last chance we all have to meet the senators since they are in their hometown. So no matter which bill comes to the floor, in the last week of March or the first week of April it is very important that we do following things:
1. During congressional recess contact Senators offices for meetings.
2. Call our Senators in their local office and talk to them on phone.
3. Send fax, letters and emails.
Please keep checking WWW.IMMIGRATIONVOICE.ORG regularly since new materials will be posted frequently. Whenever and wherever you get a chance, please convey your senators that Legal immigration system is broken and needs to be fixed.

Here is a possible scenario I might run into next year after I change employers this month and restart my GC process.
Assuming the following:
1) I have approved I-140 with new employer by Sep 2012 and I am able to port my old PD
2) My PD is Nov1 2007 under EB2. PD becomes current in Sept 2012 and I apply for I-485
3) My employment contract gets over in Nov 2012 and I have to change jobs
What happens then.
1) Will I need to change jobs based on approved I-140 ?
2) Will I be able to keep the I-485 application going ?
3) If the I-485 adjudication occurs while I am at new job and it hasn't been 180 since I filed for I485 what happens ?
4) What happens if PD retrogress in October 2012 ?

Hi,
I just got H1B. My wife is currently on her F-1/OPT. Can anyone guide me where I can find required documents to apply for H4 for my wife? Do you think I can do it myself or it needs a lawyer?
Thank you,
John

Okay, here's a shameless plug from a proud father for a worthwhile charity project of my fourteen year old daughter Eden. For the second year, she's organizing a 5-K to raise money for an art therapy program for Darfurian kids at a refugee camp in Chad. The program is run by the Hebrew Immigrant Aid Society, America's oldest refugee and immigrant assistance organization. Folks in Memphis - please consider coming out to run or walk. And others who are interested in supporting the cause can make a donation via the race web site. Thanks everyone! Eden's Run 5-K

Since stay in India need to be very short and also my travel is very near, I need to know whether it is safe to travel on an approved I 797 from my current employer?
I already have a H1 B VISA stamped on my passport with previous employer's name that expires on 30 Nov 2009.
Also, I would like to know whether I should select yes/no to the following question?
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*
Is H1B Transfer = H1B Renewal?
Thanks in advance.

I have a EB3 case from employer A, and an EB2 case as a future GC from employer B , and got the date ported from EB3 case to EB2 , got EAD and AP .Now I have started working for employer B on EAD, for the past 3 months, and now my contract might expire with the client and loose job, I have found an other job , but have to leave employer B, now my question is, can I file AC21 and leave my GC sponsoring company(employer B), or is it a very short time , and raise any doubts on being a "NO GOOD FAITH"case. Please help. All I 140's are approved.
Thanks
Pradeep

Hi,
My company filed for my GC in June'07. They goofed up and filed under EB-3 instead of EB-2. The company apologized and is ready to change my filing to EB-2. I am wondering whether this would be a good step? Following are my details.
- My PD is June07
- Labor is approved (in 1 week)
- I-140 approved
- My 6 yrs on H1 were completed in July09
- I have received 3 yr H1 ext
- Me & Spouse both have received EAD (I am not using my EAD card)
I am not tracking the progress of visa number availablilty, but I presume that EB-2 would anyday be better than EB-3.
Please advise whether chnaging to EB-2 would be a good idea?
rgds,

I am wondering what happens if I buy some real estate property ( a condo unit) while I am on H1B, and if i moved out of country, (H1B - 6Yrs completed) do i need to sell the property (condo) before i leave country? Can i rent this unit while i am away from country? On a new H1B can i come and stay in that home? Anybody experienced this case before? Please give me details as much as possible. Thanks.

Is a person who was deported almost 30 years ago, and returned to the U.S. without inspection a year later subject to the permanent bar under the 1996 immigration law? The 1996 law created the permanent bar to the immigrating to the U.S. Section 212(a)(9)(C)(i)(II)provides as follows: "(C) Aliens unlawfully present after previous immigration violations.- (i) In general.-Any alien who- ...(II) has been ordered removed under section 235(b)(1) , section 240 , or any other provision of law, and who enters or attempts to reenter the United States without being admitted is inadmissible." Filed I 485 mid June. I'm in the same boat as you, did not get receipt date. I hope they do not send the application back... I was wondering if the July bulletin affects those who filed I 485 in June.

Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)
